These Terms of Use ("Terms") govern your use of the UV Dial mobile application ("App") developed and published by BTS Innovations LLC ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

UV Dial is NOT a medical device. The App is intended for educational and informational purposes only. It does not provide medical diagnoses, medical advice, or treatment recommendations.

The AI skin classifier is a machine learning model trained on the HAM10000 dermatoscopic image dataset. It has inherent limitations and may produce false positive or false negative results. AI analysis results should never be used as a substitute for professional medical examination.

4. Subscriptions and Payments

UV Dial offers premium features through auto-renewable subscriptions:

Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.

You can manage or cancel your subscription at any time through your Apple ID Account Settings. No refunds will be provided for any unused portion of a subscription period, except as required by applicable law.

Prices are in USD and may vary by region due to exchange rates and local App Store pricing. We reserve the right to change subscription prices. Any price changes will take effect at the start of the next subscription period following the date of the change.

UV Dial, including its design, code, AI models, content, and branding, is the intellectual property of BTS Innovations LLC. All rights are reserved. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

WE MAKE NO WARRANTY REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY AI-GENERATED ANALYSIS, UV INDEX DATA, BURN TIME ESTIMATES, OR OTHER INFORMATION PROVIDED BY THE APP.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BTS INNOVATIONS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APP.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless BTS Innovations LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your use of the App or violation of these Terms.

The App uses Open-Meteo for weather and UV data, and Apple's StoreKit for subscription management. Your use of these services is subject to their respective terms and conditions. We are not responsible for the accuracy or availability of third-party services.

We reserve the right to suspend or terminate your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

13. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

In addition to these Terms, your use of the App is also subject to Apple's Standard End User License Agreement (EULA), available at apple.com/legal/internet-services/itunes/dev/stdeula.
